Please read these Terms of Service ("Terms") carefully before using the HMD Gear website and services. These Terms govern your access to and use of all content and services offered by HMD Gear.

By accessing or using any part of the site or services, you agree to be bound by these Terms. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.

1. General Conditions

HMD Gear operates as a print-on-demand company. All products are unique and produced only once ordered. This custom production process impacts our return and exchange policies.

2. Products and Orders

2.1. Product Uniqueness: All products sold by HMD Gear are custom-made upon order. This means that each item is unique and specifically created for you.

2.2. Order Accuracy: It is your responsibility to ensure the accuracy of your order, including but not limited to, selected sizes, colors, and designs, before submitting your purchase. HMD Gear will not be held responsible for errors in ordering.

3. Pricing and Payment

All prices for products are as listed on the HMD Gear website and are subject to change without notice. Payment must be received in full before an order is processed and produced.

4. Shipping and Delivery

4.1. Delivery Timeframes: Estimated delivery times are provided for your convenience. However, these are estimates only and actual delivery times may vary.

4.2. Unsuccessful Delivery: In the event of an unsuccessful delivery, you may opt for a reprint with an additional charge, or a partial refund.

5. Returns and Refunds

5.1. No Returns for Customer Error: Due to the custom, print-on-demand nature of our products, HMD Gear does not support returns or exchanges if you ordered the wrong size, color, or simply changed your mind.

5.2. Damaged Products or Manufacturing Errors: * In case of a damaged product or a manufacturing error, HMD Gear offers a free reprint or a full refund. * You must contact HMD Gear within 30 days of product delivery to be eligible. * To initiate a claim, you must provide clear photo(s) showing the issue. There is no need to return the damaged product. * If an issue affects multiple products using the same design, an additional photo or video showing all affected items in one frame will be required.

5.3. Print Placement Tolerance for DTG Products: For Direct-to-Garment (DTG) products, a tolerance of 0.5 inches (approximately 1.27 cm) for print placement is considered acceptable. Minor variations within this tolerance will not be considered defects.

6. Intellectual Property

All content on the HMD Gear website, including text, graphics, logos, images, and software, is the property of HMD Gear or its content suppliers and is protected by international copyright laws.

7. Limitation of Liability

HMD Gear shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of Illinois, United States, without regard to its conflict of law provisions.

9. Changes to Terms of Service

HMD Gear reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
